Abstract

By analysing various perspectives and legal frameworks, this article aims to put light on the complexities surrounding the functionality of UCC and its implications for a pluralistic society.

Introduction

A Uniform Civil Code (UCC) enshrined in Article 44 of Constitution of India refers to a set of laws regulating personal matters such as marriage, divorce, succession, and adoption, applicable uniformly to all citizens irrespective of their religious background. In the nations like India, where personal laws are based on customs and religion, the notion of UCC has been a topic of discussion for decades, aiming to promote equality, secularism, and social cohesion. However, due to the diverse spiritual and customary landscape of the nation its implementation poses various challenges.

Significance of a Uniform Civil Code

Proponents of UCC argue that it is crucial for ensuring equality and justice, particularly in matters affecting women’s rights. India’s existing personal laws often perpetuate discriminatory practices against women, varying rest on religious affiliations. By enacting a UCC, these disparities can be addressed, promoting gender equality and empowering individuals to exercise their rights without discrimination.
